Prostitution often referred to as the oldest trade in the world is probably the most undesirable profession and definitely the most widely and daringly abused through laws by any government. Why?
Call it male chauvinism, desire of the flesh, loopholes in the legal system, poverty or what not, but as long as there is demand created by customers, prostitution will continue to flourish.
So to bring an end to this demeaning trade we need a two prong strategy, one to stop demand and another to cut off supply. In all realistic terms we know that there is no immediate solution to bring an end to prostitution, but with changes to our legal and social system, we can alleviate the challenges to those affected by the sex trade and punish those who propagate it.
My interest in this issue increased after my visit to Thailand this summer and after reading the book ‘Sex Slaves’ by Louise Brown. I thought I knew a lot about it until then. Hundreds of billions are made in this trade and millions of women and men are affected by it through a well-connected web of groups operating domestically and internationally. Some of these mafia groups operate better than Fortune 50 companies.
After coming back to Toronto, I saw a policy resolution from the Young Liberals of Canada demanding the legalization of prostitution. This got me on my foot. I did some research online and spoke to friends who worked in this area, both those who supported legalization and those who opposed it. There is one thing everyone agrees on - we need to strengthen national and international laws to prevent trafficking of sex slaves and punish those customers who are creating the demand for prostitutes in the market, especially minors. UN convention and laws in most developed and developing countries are very weak to prevent or punish those involved in trafficking, pimping and seeking prostitutes. Prevent if not punish the perpetuators. If there is anyone in this forum who disagrees, raise your voice, I will like to get your views.
The second part is the tricky one. There are people who want to legalize prostitution and those who don’t. Why should we legalize prostitution? Because like any other profession, people in sex trade deserve work place safety and legalization will provide social and legal benefits. Legalization will give men/women involved in the sex trade access to proper health care, sex education and legal rights. At this time because the trade remains underground, it makes it difficult for social workers and government to access these people. Legalization can help many escape from the clutches of pimps and brothels and practice in a safe environment. Many countries in Europe have legalized prostitution and millions of women have independent or salaried worker status that allows them to avail several government benefits. Some African countries like Ghana and others in South East Asia like Thailand and Philippines are looking at it to prevent the spread of HIV/AIDS.
The model that I propose and I like is Sweden’s 1999 legislation. The law is very simple. A) Criminalize the buying of sex, and b) decriminalize the selling of sex. The Swedish government estimates that in the last few years only 200 to 400 women and girls have been annually sex-trafficked into Sweden, a figure that's negligible compared to the 15,000 to 17,000 females yearly sex-trafficked into neighbouring Finland and similar trends in Germany and Netherlands where half of the sex workers are of foreign origin. Sweden also earmarked liberal funds to help those who want to come out of it and also educate the public. This model is similar to the Canadian Marijuana law, which decriminalizes the possession of weed less than 30 grams and has tougher sentences for dealers.
India, which is troubled with a growing AIDS population, poverty, trafficking of women and girls, mafia- law enforcement nexus and many other problems, will find it even more difficult to prevent and protect those who are pushed into the sex trade. India also being fairly socially and religiously conservative, I think legalization of prostitution might not be a solution, yet. We should decriminalize the selling of sex by the individual involved in it and criminalize the buying of sex and pimping with a 1 to 6 month sentence for the customer and 10 years for the pimp. The Swedish meat ball way. What do you think?

I've seen a few documentaries where several prostitutes from India spoke on camera.
This is the summary of what they said -
0. majority of customers are heavily intoxicated due to liquor before they have sex.
1. customers are so scared they routinely wear 3-4 condoms on top of each other, to prevent aids & any sort of pregnancy.
2. very few customers have actual sex ie. penetration.
since customers are all intoxicated, they indulge mostly in mutual masturbation ie. stroking of the penis by hand, accompanied by leery sexual remarks. The customers, who are already intoxicated & fantasizing about Bipasha or Mallika or the current sex bomb, come immediately when their organs are hand-stroked. They then wipe off the cum, pay the 50-100 rupees and stumble out with a lot of guilt.
3. this cycle repeats every few weeks.
So it is not like the movies you watch say Jism, Murder etc. where cleanly shaven macho guys spend hours in various postures giving hot orgasms to their partner. It is a very hurried affair, gets over in 10 minutes on average, and is 90% masturbation, not real sex. Basically, Indian customers of prostitutes are simply engaging in masturbation, which is seen as a completely harmless practice in USA & the West, but is still considered taboo in India ( there is no word for masturbation in several Indian languages ).
I have heard from several American kids whose mother/father caught them masturbating to Playboy channel or Penthouse & simply laughed & walked away, because they know it is just puberty & hormones. So it is a very harmless thing & nobody bothers about it in the West. Whereas, in India, if your mother catches you masturbating in your pillow or wet towel, consequences will be disastorous - she will think you are having sex!!!
Harmless release of semen is seen as taboo in India.
Another important tidbit - majority of prostitutes in India are shemales ie. hijras. So basically Indian male customers are paying good cash to masturbate with another half-male! It is really funny if you think about it.
I have also spoken to a real prostitute at length about it. She is a film actress in Bollywood who does prostitution on the side for more money. She charges 50,000 rupees, and she told me it is the easiest way to make money in India because again, there is no real sex. Her customers have already seen her in various item numbers. So they come to the hotel having a huge erection because of the fantasy playing in their minds. She gets them drunk on Chivas Regal, and after a few glasses, she murmurs a few "dirty words" in Hindi in their ears, and reaches out for their penis. The custoimer is so excited by that time, he comes readily & profusely on her hands. She then washes her hands, takes his money & heads him out the door. The process takes 10-15 minutes tops, and the customers are paying 50,000 rupees for this!
I seriously feel very sorry for Indians. They are so sex-starved they are paying good cash for harmless masturbation with shemales!

Vijay - This proposal doesn't make sense. Pimping and trafficking should definitely be criminalized but I don't seen how (b) will work if (a) is in place, i.e., how will the prostitues get their health benefits, pay taxes etc. if their work is considered to be in partnership with criminals.
Perhaps Sweden doesn't grant benefits to sex workers but only takes care of them when they are in trouble. What is the Netherlands model, do you know?

Thank you Marek. That Netherlands prostitution policy is simply wonderful...it can be listed as a hallmark of free trade & total economic freedom.
However, as I have outlined, sex has not just economic but cultural components. In Scandinavia, having sex is as common as having a cup of coffee, so there is no great moral dilema involved. In India, even mentioning the word sex can get you in trouble in say high school.
If you have tried to make an Adult Film in India, you will see that it is easier to scale the Everest than trying to get a Censor Certificate. Most of what is called "A" film in India simply has a woman showing some cleavage & walking in a bikini...and even those posters aren't allowed on the walls on the street. Whereas here in the West you turn on the TV or open the New York Times, you'll find a Victoria Secrets ad that has more sexual content than any Indian Adult film.
Just talk to a bunch of Indian youth & they'll tell you how sex-starved it is out there. People in India think dating means holding hands & going to a Bollywood movie...& worst case, kissing. Sex is not even a possibility. I know of several 25 year old guys, successful & educated, who think they have to put their dick in the woman's navel - I kid you not! Whereas here in the US, every girl has lost her virginity by 16. Its just very different out there.
For a long time, there was a magazine in India called "Debonair" which was considered hardcore porn. Now, I guarantee you, even a 10 year old schoolkid in the US would have more sexual material than the Debonair mag...they were just normal girls sitting on a couch with no bra, and that is porn ?!! India is such a fun country.

We need to start somewhere for this and the best thing is to raid all brothels in India and bring the women out and then help them out. Give fullhealth protection, treat the ones wtih HIV, protect them from Pimps. then only we should consider legalization or anything else.

This is a good idea for india, but there are no politician in India who can take this fight up. Mnay Indians will get offended, even though decriminalization will help reduce HIV and abuse of women in brothels.

your reference to Clinton is vague and tryng to educate 1 billion people in India is very difficult, when the word sex is a tabboo in India. I like Filamker's remarks, very raw but true of the situation in India. We have seen the stories of cell phone MMS of teenage girls.
India needs to revolutionize its prostitution area through tough measures like Sweden.
I think we should continue to support organized crime and keep it illegal. As we all know anything made illegal creates a black market and produces billions in profit for the criminal enterprise.
Not only does this provide campaign money for corrupt politicians it provides income for defense lawyers and companies that support the prison system. All the people in the judicial and court systems make a living from this as well.
It is very similar in nature to the business of war, very profitable and resulting in violence.
So I suppose you would not find many politicians that would go against organized crime and support legalization.

I just said that it is simply impossible to catch each and every one involved in prostitution. How can this be vague? Lemme know. I will be happy to discuss about it.
Also I didn't connect Clinton with trying to educate 1 billion people in India about sex. What gave you that impression. I was just saying that we need a proper sex education in India. The lack of such an education is the reason for not only flourishing sex trade but also for many domestic abuses which women in India face. I do agree that it is more difficult to do in reality. I have a hard time seeing how you make selling something illegal when it is perfectly legal to give it away. To be perfectly honest, sex is purchased legally all the time. Women marry men for their money all the time (and the other way around); a 75 year old male multi-millionaire that marries a 25 year old supermodel KNOWS (and so does everyone else) that the marriage is about money. He's bought a companion...she knows it and is okay with it...in fact she feels fortunate. How is that different than some guy buying an evening of sex for $100? Really it is no different. To me the main difference is that we think it's okay (even sort of cute and admirable) that an old millionaire is sleeping with a woman that could be his great granddaughter, but an average middleclass guy that may not be the best looking chocolate in the box is lonely and horny but can't afford to buy a wife is looked at as some sort of deviant.
The real prostitution is that since it is illegal typically, only the most desperate young women and men engage in selling it. If prostituion were to be legalized, regulated and taxed it would be safer for the men and women selling and safer for those buying. Money and time could be then focused on eradicating sexual slavery and the child sex trade.

Exactly. It is no different from smoking or drinking. It will be better if they make it legal, give proper education (as it is done for smoking and drinking) and regulate it properly. This will definitely reduce the risks associated with prostitution and may eventually make it not so attractive.
Just read the Netherlands policy. Thanks Marek. They seem to have it all covered. Vijay, I'm surprised you opted for the Swedish model instead. The more I learn about the Netherlands, the more I like it. If only their climate wasn't so bad I would have been so tempted to move there.

I think legalisation might work for a developed country or a country with a small population base. In a Country like India, legalisation is a distant dream and with corruption from the law enforcement being a major challenge, legalisation may lead to several other challenges.
What the Swedish model is trying to achieve is that take the onus off the women and put it on the customer. Many women are forced/trafficked into prostitution. By decriminalising, health care workers and counsellors will be able to interact with them for their needs. Prostitutes will be willing to come forward to seek help, because they know they won't be punished for it. Our focus is to help men and women prostitutes and not make it easier for people to profit from it.
By criminalising the act of buying and pimping , you want to cut the fuel line that is keeping this trade alive. This will keep pressure on the pimps and customers.
It has been seen that full legalization, has shown an increased number of women in the trade, mostly foreign origin and illegal in Europe.
In a country of 1 billion, where the mafia is very closely knit with law enforcement, full legalization will lead to more burden on women. Decriminalization will help remove harassment's for the prostitutes and still leave legal room for prosecuting pimps who force women and girls into it.
Interesting.Cleaning brothels in India will not only resolve the problem of the abused women but also reduce petty crime in the regions. I read somewhere that brothels are breeding grounds for criminals. By decriminalisation it would be possible to get the women to speak and as we know from history, many an empire have crashed because of men talking too much to the other woman. Prostitutes will have a lot of information on criminal activities and also police officers who are in bed with the criminals.

Dude, don't compare killing with prostitution. There is a physical damage done to another person in killing. While in prostitution, there is no physical damage done to another person. At the max, they kill a few sperms which people do otherwise too. Your comparision is ridiculus. I don't support prostitution but it is definitely not on par with killing. If you guys are serious about solving/minimizing the issue, stop the moral crap and think logically about the best way to tackle the issue. If morality is the criteria, it is subjective. Comparing prostitution with killing is quite inaccurate. The person getting killed has not given his consent. We are talking of consenting adults trading sex for money. Depending on the viewpoint of a society, it can be called undesirable,unsocial or immoral, but in no way criminal. Some may consider it morally harmful, like say adultery, drinking, or even masurbation. But criminal? Why? A closer case could be consensual bribe-taking and bribe-giving. But if one in a position of power takes bribe for taking an unfair decision, he or she is harming someone else's bona fide interests. Which is not the case with prostitution. In the case of a married man, you can say the wife is the aggrieved party. But that is a case similar to adultery, and can be treated as such.

Vijay, Your ideas may work here in Canada or in any other developed nation. When it come to India laws are not that effective. Well, at least in my experience that is what I have seen.
As long as there is corruption no laws can work well. I would rather prefer a topic on legalizing corruption than legalizing prostitution.
I think we need to do a lot of clean up on the ground even before taking this subject. (for India)

I applaud what the Netherlands legislation is attempting to do. But I have a hard time still with criminalizing the purchasing of sex. I just don't see what is wrong with it. I personally have no desire to buy sex, but I really don't care if two consenting adults want to exchange money for sex. As I mentioned it happens legally everywhere in the world.
What you are outlining as the problems with the sex industry happen in many other industries: Children working in factories for next to nothing. What the problem is is not sex, the problem is the theft of anothers labor. These women are having their labor stolen by others and when that happens we call that slavery. ANY time one person or groups of people remove anothers choice, that is slavery and THAT must be erradicated.
THere is a theory of economics (which I subscribe to) called the "Economic Man" or "Natural Man" theory (basically states that people will pursue their own interests no matter what law you pass). You can never fully illegalize certain things economically that people want. That's why prohibition didn't work in the US and that is why the War on Drugs has been such a failure. You can't stop people from smoking something that grows naturally in their yard. And you can't stop people from trading sex for money.
Arguing that the free exchange of money for sex by two informed adults is the same as murder is silly. Murder deprives another of his right to live and prostitution deprives no one of their rights any more than paying $5 for submarine sandwich deprives someone of their rights.

Framing of law enforcement question is insufficient.
1. Stricter laws in Europe has resulted in clients traveling to places like Thailand.
2. Access to legal system is unequal as indicated most recently by the Guria incident.
3. External visible and quantifiable exploitation does not say anything about what goes on within the four walls of the home.
While laws have their place, I have been leaning towards the question of the larger structures and dynamics that puts the clients and women in place.
Where do women in Goa come from, for example? From the interior regions of AP and Karnataka, among other places. Why? Economics among other things.
Many traffickers are relatives/friends. Why would one sacrifice the life of somebody you know well for the sake of few thousand rupees?
Why is that the trafficking continues when everyone knows that it is illegal and happening in broad daylight? What the responsibility of
the larger society? What are the real options for the women, anyway?
The questions are complex and require approaches that have "depth".
My own thesis trafficking and sexual exploitation are part and parcel
of the larger scheme of things that depends on exploitation. It is connected in fundamental ways to other forms of exploitation -
economic, social, political, gender and physical. Until we address the fundamental inequalities, we are not going to make any dents.
Prostitution is here to stay.

In a country like India, where prostitution is linked with the Mafia and Politicians (not a direct relationship) it is difficult to legalize the same.Once we do that, the next question comes up and that is corruption in a so called legalized business.
I would look to increase the entry barriers into this profession and remove the exit barriers. That way you get a regulated industry but with lesser people coming in, and then you bring regulation of this industry and treat it as a regular offence. Maybe i am rambling my head away, but i guess this is what this industry needs.
Also, once the barriers are higher for sex workers, the footfalls become lower hopefully.
And as far as freedom in india, look back at the incident which happenned in Madras over kissing and dancing in public !

I wonder if it is at possible to 'bring an end' to prostitution, for very many reasons - no wonder it is referred to as the oldest profession in the world. I think it is better to try and limit the damages that accrue and to make life a lesser burden for those who bear the worst brunt, the women themselves.
The Swedish option of decriminalising the selling of sex and criminalising the buying makes sense, to some extent, if it means prosecute the client not the prostitute. I wonder if that is the intent?
It makes more sense to me to accept it as a way of life which no laws will ever be able to eliminate. I am for legalizing the prostitution. My idea for legalizing prostitution is simple. By criminalizing it, you cannot stop prostitution at all. I am just going to use the modified version of what Clinton said in a meeting in Gainesville, Florida. Clinton was arguing against agression as the only means of eliminating terrorists and during the part of his argument he used the sentence "It is impossible to hunt down each and every terrorist". I am using a similar argument in this case against criminalization. It is impossible to catch each and every person who buys sex. In such a scenario, by legalizing prostitution, you get a chance to reach out to them and educate them about the problems associated with "bad sex methods". The only way to curtail prostitution is to educate people about it and make them realize the problems associated with it. You cannot curtail it by force. The only way is to reach out to the supply side and demand side and educate them about it. Their realization is an absolute must for bringing this issue to a close (or closer to that stage). To bring about this realization, you need to bring the practitioners to the mainstream society. This can only be done by legalizing it.
In India, the problem needs to be addressed differently. More than the need to educate the practitioners of this trade, you need to educate the entire population about sex. It is all messy out there. You need to bring sex education to the fore front.
